What crime? Plenty of knock off games have been taken to court and won. It just has to be different enough, and looking at the pics and vids it certainly wouldn't confuse any reasonable person into thinking it's actually The Last of Us.

Sony is just using scare tactics. And they're succeeding. Although, I'm not saddened in this case, since apparently the game was also shovelware garbage.
