The only "miscommunication" was that they didn't obfuscate the terms through legalese more thoroughly.

I mean, it seems pretty clear to me. Nice simple language. Clearly defined common terms. Not much room for misunderstanding or miscommunication.

Unless this is a very peculiar way to spell “We got caught with our pants down.”

Yeah, there was zero miscommunication here. They got caught with their hand in the cookie jar and now they're trying to bullshit their way out.

So im out of the loop on what happened her both in the game and the legal terms but im guess marvel got caught and are pulling the “whoops I didn’t mean to” card

In a nutshell: You are only allowed to write reviews if you promised to write good reviews.

In another post there is a screen shot.

But the basics are, the agreement you had to sign to get into the play test. Has a line that said you couldn't say anything bad about the game.

The agreement was for "offical content creators" not for access to the closed beta.

essentially its similar to product sponsorships and product reviews. Product sponsorships give the sponsor all the power to censor parts they dont like. Reviews should be honest and reveal something is good or bad.

they tried to say in order yo get into beta you can only say good stuff, so any online footage is similar to a sponsorship rather than an honest review
