It would be more accurate to say that 'the court formally codified the policies US presidents have already been using for the last century'.

I was unfamiliar with this guy. His interpretation seems to have held up in practice, although it hinges on definition of war. If by "war" he means a defacto state of war without declaration, then he must have concluded the US is a carte blanche dictatorship, right?
