The agency had first proposed to revoke the regulation in November 2023. According to the Center for Science in the Public Interest, BVO was banned in the UK in 1970, followed by India in 1990, the EU in 2008 and Japan in 2010.

With Chevon overturned, what are the odds beverage companies sue the FDA saying that Congress didn't explicitly authorize them to ban BVO?

I'm not a gambler, but I would go all in on that bet. I also see that happening for every new regulatory decision from the FDA, EPA, et al.

They lied about in the article, Mountain Dew is owned by Pepsi.

“Sun Drop, manufactured by Keurig Dr Pepper, still uses BVO ... This is probably the biggest national brand that still uses it,” said CFRA Research’s Arun Sundaram.

Edit: I guess I didn't notice the probably the first time around, way to go CRFA Research (a global reserch investment company).

Founded as the Center for Financial Research and Analysis in 1994, today our company is simply known as CFRA.

Reading through that list wondering how much damage I did to myself and chuckling at mountain thunder. Also, super lucky it looks like none of the citrus shit I used to drink is on there.
