The article explained why the appropriated funds can't cover this and the limits promised exceed the amounts opm can pay people. It's not that what he's doing is illegal, it is that there is no legal way for his promises to be fulfilled. He can promise whatever he wants legally, there's just no way to make it happen within the government.
